Again, El Ratón 'was saved' from being sent to the United States for the crime of drug trafficking



In order not to be extradited to the United States for fentanyl trafficking, a federal judge in the State of Mexico granted Ovidio Guzmán — son of Joaquín "El Chapo" Guzmán and leader of the "Los Menores" faction of the Sinaloa Cartel — a new provisional suspension to stop said procedure.

The head of the Fifth District Court in Matters of Amparo and Federal Trials, upon assuming jurisdiction of the case, granted the precautionary measure so that "El Ratón" is not handed over to the US authorities and remains imprisoned in the maximum security prison of the Altiplano in Almoloya de Juárez, State of Mexico, for his disposition with the judge responsible for the case.
Therefore, until a definitive suspension is issued, the judge determined that "this precautionary measure is granted, to the effect that the direct complainant (Ovidio Guzmán) is not extradited and remains at the disposal of this court of amparo, as far as his personal freedom is concerned, in the place where he is imprisoned and at the disposal of the responsible judge, without prejudice to the continuation of the extradition procedure under investigation; the foregoing, until the definitive suspension is issued."
Accepting the jurisdiction of the case declined by the Sixth District Judge of Amparo in Criminal Matters in Mexico City and avocado to the knowledge of the matter.
That is, within amparo 63/2023, the judge maintains that said suspension does not affect in any way the extradition process, since it prevents "El Ratón" from being sent to the US while his amparo trial is resolved in its entirety.

In addition, it reiterated the outright suspension issued by the declining court, in relation to the acts claimed by Guzmán López consisting of solitary confinement, physical or psychological torture.
Meanwhile, on January 24, the Fifth District Judge will decide whether to grant the definitive suspension or not. It should be recalled that the son of "El Chapo" Guzmán is wanted by the District Court of Columbia on the charge of conspiracy to distribute cocaine, methamphetamine and marijuana.
